Terms of Service

These terms are a legal agreement between you and DCyberLab for using GamCinama. Please read them carefully. Section 8 contains additional terms for creators who publish on the platform.

1. Agreement

GamCinama (the “Service”) is operated by DCyberLab, Bakoteh, Banjul, The Gambia (“we”, “us”). By creating an account, buying a Channel Pass or uploading content you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Your account

  • You must be at least 13 years old. Under-18s need a parent’s or guardian’s permission.
  • Give accurate details, including a phone number you control.
  • Keep your password secret. You are responsible for activity on your account. Tell us immediately at ebrimaa2ray@gmail.com if you suspect unauthorised use.
  • Accounts are personal. Do not sell, share or transfer your account.

3. Channel Passes

  • A Channel Pass gives you a personal, non-transferable, non-exclusive right to stream the paid titles on one creator’s channel for the number of days shown at checkout, for private, non-commercial viewing.
  • Passes do not renew automatically. Access ends at the end date shown in your library. Buying another pass for the same channel before it ends adds the new days to your remaining time.
  • Creators may add, change or remove titles on their channel during your pass. A pass is access to the channel, not a purchase of any specific title.
  • Free titles and trailers may be watched without a pass. You may not download, record, re-stream or redistribute any content.

4. Payments

  • Prices are set by each creator and shown in Gambian Dalasi (GMD) before you pay.
  • Payments are processed by our payment partner ModemPay using Wave, Afrimoney, QMoney or card. Your use of those payment methods is also subject to their terms. Your provider may charge its own fees.
  • A pass is activated once the payment provider confirms the payment. If confirmation is delayed, your pass will activate when it arrives; you will not be charged twice for the same checkout.

5. Refunds

Because a Channel Pass gives instant access to digital content, passes are not refundable once they are active, except where:

  • you were charged but the pass never activated (a failed payment);
  • you were charged more than once for the same checkout (a duplicate charge); or
  • the law requires a refund.

To request a refund in these cases, email us within 30 days with your phone number, the date and the payment reference. Approved refunds are returned to the original payment method where possible. If a creator’s channel is removed for breaking these Terms we may, at our discretion, extend or credit affected passes.

6. Acceptable use

You agree not to:

  • copy, download, screen-record, re-stream, sell or share content or pass access;
  • bypass or interfere with access controls, signed links, or security features;
  • use bots, scrapers or automated means to access the Service;
  • make fraudulent payments or chargebacks, or use someone else’s payment method;
  • harass others, impersonate anyone, or use the Service for anything unlawful.

7. Content & ratings

Titles are made and published by independent creators, who are responsible for them. Some titles carry age ratings (ALL, PG, PG-13, R18); you must respect them. We may remove or restrict any content that breaks these Terms or the law. Views expressed in titles are those of their creators, not DCyberLab.

8. Creator terms

These additional terms apply if you run a creator channel. Your individual onboarding agreement with us (including your revenue share) forms part of these Terms; if they conflict, the onboarding agreement wins.

8.1 Your content and rights

  • You keep ownership of everything you upload. You grant DCyberLab a worldwide, non-exclusive, royalty-free licence to host, encode, store, display, promote (for example with posters and trailers) and stream your content to users of the Service for as long as it is published and for a reasonable time after removal for backups and records.
  • You confirm that you own or have all rights, licences and permissions needed for every part of your content — including music, footage, scripts and the consent of people who appear in it — and that it does not infringe anyone’s rights or break any law. You are responsible for claims arising from your content.

8.2 Pricing, revenue share and payouts

  • You set your pass prices and durations within the limits shown in your Studio.
  • For each successful payment, your share (as agreed at onboarding and shown in your Studio) is credited to your balance; the remainder is the platform fee. Refunded or reversed payments may be deducted from your balance.
  • You can withdraw your available balance to a mobile-money account in your own name. Withdrawals may be subject to minimums, limits, a holding period, transfer fees and review, as shown in your Studio. New payout accounts may have a short waiting period before first use for security.
  • You are responsible for your own taxes on your earnings. We may hold or withhold amounts if we suspect fraud, a chargeback, or a breach of these Terms.

8.3 Your channel

  • Keep your Studio login secure; you are responsible for actions taken in it.
  • We may unpublish titles, suspend your channel or withhold payouts if you break these Terms, if we receive a credible rights complaint, or if required by law. While suspended, existing viewers keep the time left on their passes where possible.

9. Copyright & takedowns

We respect intellectual property. If you believe content on GamCinama infringes your copyright, email ebrimaa2ray@gmail.com with: your contact details; the work you own; the link to the content; and a statement that the information is accurate and that you are the owner or authorised to act for them. We will review promptly and may remove the content and notify the creator, who may respond. Creators who repeatedly infringe will have their channels terminated.

The GamCinama name, logo and software belong to DCyberLab and may not be used without permission.

10. Suspension & termination

You can stop using the Service and delete your account at any time. We may suspend or close accounts that break these Terms, are used for fraud, or put other users at risk. Where closure is due to your breach, unused pass time is not refunded.

11. Availability

We work to keep GamCinama available and fast, but streaming depends on your device, network and third-party providers. The Service may be interrupted for maintenance or reasons outside our control. Features may change over time.

12. Disclaimers & limitation of liability

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, DCyberLab is not liable for indirect or consequential losses, lost profits or data, or for content created by creators. Our total liability to you for any claim is limited to the amount you paid us in the three months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

13. Governing law & disputes

These Terms are governed by the laws of the Republic of The Gambia. Please contact us first so we can try to resolve any problem informally. If we cannot, disputes will be handled by the competent courts of The Gambia.

14. Changes to these Terms

We may update these Terms. The date and version at the top show the latest change. Significant changes will be announced in the app before they take effect; continuing to use the Service afterwards means you accept them. Passes already bought keep the terms under which they were bought until they end.
